NDDC Board Never Underwent Extension – SGF

An allegation was made by Sen. Emmanuel Paulker (PDP Bayelsa), that the present board of the Niger Delta Development Commission (NDDC) was extended but SGF reacted to Senate’s resolve to investigate this allegation.

The SGF reaction came in a letter signed by the Permanent Secretary, Mr. Dayo Apata. With the title: Re: Clarification on the Tenure of the Governing Board of the NDDC.

Secretary to the Government of the Federation said the present board headed by Ndoma Egba was not a continuation of the dissolved board headed by Bassey Henshaw.

His clarification was:
Section 5(2) of NDDC act is addressing a situation where an opening occurs as a result of any of the provisions of section 5(1) of the NDDC act as against when the entire board is dissolved. In this case, the past NDDC board was resolved and its term concluded.

He added by saying dissolution simply meant the board no longer exist and was not categorized as vacancy under the NDDC ACT.

Paulker in a motion earlier in the day added to his allegation that contrary to the clear provisions of Section 5 (3) of the NDDC Act, the tenure of the present board had been unlawfully extended to 4 years by the immediate past Acting Secretary to the Government of the Federation in the person of Dr Habiba Lawal.
